These are the Terms of Use that apply to any of our websites (“site(s)”) whether accessed through the internet or any other electronic means.

This site is controlled, operated and administered by us from offices within the United States of America and for the purpose of servicing our policyholders and assisting independent insurance agents in the marketing and promoting of our products and services solely within the following states. We make no representation that our products and services or the materials at this site are appropriate or available in all states.

Insurance Policy Terms and Conditions Control

All coverage information provided by this site is in general terms and is superseded in all respects by the Insuring Agreements, Exclusions and Conditions of the Policy. Some coverages or discounts may not be applicable in all states or may have to be modified to conform to applicable state law. Some coverages or discounts may have been eliminated or modified since the posting on this site. The issuing, renewal, or cancellation of any insurance policy, policy terms and conditions, and rates are subject to underwriting review.

Use of Materials

We authorize you to view and download materials from this site only for your use in connection with the lawful purchase, marketing and/or evaluation of our products and services. This authorization is not a transfer of any rights in the materials. Your use of this site establishes a business or other applicable relationship with us for purposes of CAN-SPAM, the Telephone Consumer Protection Act, and all other applicable law that addresses unsolicited commercial communications. Privacy Notices and Authorized Use of this Site

You are entirely and absolutely responsible for all activity performed or information disseminated through the use of your Login Credentials. IT IS A VIOLATION OF THESE TERMS AND CONDITIONS FOR YOU TO ALLOW ANOTHER PERSON TO USE YOUR LOGIN CREDENTIALS FOR ACCESS TO THIS SITE. PLEASE KEEP YOUR LOGIN CREDENTIALS CONFIDENTIAL.

Changes to and Availability of this Site

Limitation of Actions

Except for policyholders having a legal right to bring a suit or other action against us within a state where a policy is issued, you irrevocably consent to the Choice of Law, Jurisdiction and Venue and Dispute Resolution provisions below.

Choice of Law, Jurisdiction, and Venue

The laws of the State of New Hampshire and the federal laws of the United States govern these Terms of Use. Any suit or other action arising out of, or in any way connected with, your use of any site may be brought only in the exclusive jurisdiction of the United States District Court for the District of New Hampshire.

Other Method of Dispute Resolution

In lieu of civil litigation, at our sole discretion, we may elect to have any dispute arising out of or related to your use of, or association with, this site to be settled solely by binding arbitration in accordance with the Commercial Dispute Resolution Procedures, or where appropriate, the Supplementary Procedures for Consumer-Related Disputes of the American Arbitration Association. The place of arbitration will be in the vicinity of Concord, New Hampshire. The arbitration will be conducted in English. Any award by the arbitration panel may be entered in, and enforced by, any court of competent jurisdiction.

Partial Invalidity

If, for any reason, a Court of competent jurisdiction finds any provision of the Terms of Use or the Privacy Policy, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the Terms of Use and the Privacy Policy, and the remainder of the Terms of Use and the Privacy Policy shall continue in full force and effect.

Disclaimer of Warranties

THE SITES AND ALL MATERIALS MADE AVAILABLE ON OR THROUGH THEM ARE PROVIDED CONDITIONAL ON THE USER RECOGNIZING THAT THE QUALITY, AND ACCURACY OF THE INFORMATION OBTAINED FROM THE SITE MAY DEPEND ON THE USER PROVIDING ACCURATE INFORMATION. Definitions

The following defined terms are used in these Terms of Use:

"Business Day" means Monday through Friday, excluding Federal Reserve holidays.

"Payee" means the merchant or other entity to which you authorize a bill payment to be directed.

"Payee Account" means the billing account with the merchant or other entity to which you authorize a bill payment to be directed.

"Payment Account" means the bank account that you authorize us to debit by electronic funds transfer when you make your bill payment using account information from your personal checking or savings account.

"Payment Card" means the credit card or debit card that you instruct us to charge to pay your bill payment.

"Payment Instruction" means your instruction and authorization to us to make a bill payment to a Payee.

"Scheduled Payment Due" means the Business Day of your choice upon which we will attempt to complete your bill payment and initiate the appropriate debit to your Payment Account or Payment Card.

Description of Services

General Site Usage

The online services provide users with access to various on-line resources, including applications that allow you to view your bill. Unless explicitly stated otherwise, any new features that augment or enhance the current online services, including the release of new services, shall be subject to these Terms of Use. Upon your acceptance of these Terms of Use by clicking on the "I Accept" button below, we grant you a personal, nonexclusive, nontransferable, license to access and use the Services, subject to these Terms of Use, solely for your internal purposes. The forgoing license includes the specific rights to use the available applications and functionalities of the Services and to print information from the Services.

Bill Payment Service

When you initiate a Payment Instruction, you authorize us to charge your Payment Card or debit your Payment Account and remit funds to us on your behalf so that the funds arrive as close to the Business Day designated by you as is reasonably possible. While it is anticipated that most transactions will be processed on the day you choose, it is understood that due to circumstances beyond our control, some transactions may take a day or so longer to be credited to your account.

If we are unable to obtain funds for a bill payment for any reason associated with your Payment Card or Payment Account (for example, there is not a sufficient balance available on your Payment Card or in your Payment Account to cover the transaction), then we will not be able to complete your bill payment transaction. If there is a problem in processing your Payment Instruction, we may attempt to contact you, using the telephone number you have provided.

If we make a bill payment to your account but are unable to obtain funds for that payment from your Payment Card or Payment Account, you agree that your bill payment will be reversed.

You further agree that by accepting these terms of use, you also authorize us to receive and process single and/or recurring payments Instructions from you over the telephone.

Our Liability for Failure to Complete Transactions

We will use commercially reasonable efforts to process your bill payments in accordance with your Payment Instructions. However, we shall incur no liability if a bill payment is not made in a timely manner or if it is unable to complete any payments initiated by you through the Bill Payment Service because of the existence of any one or more of the following circumstances:

  • Sufficient funds are not available through your Payment Account or your Payment Card;
  • Failure of any Payee to account correctly for or credit the payment in a timely manner, or otherwise mishandle or delay the payment;
  • The bill payment service is not working properly and you know or have been advised by us about the malfunction before you execute the transaction;
  • You do not provide us with all required information to complete the bill payment, such as your correct name, telephone number, or your complete and correct account information; or
  • Circumstances over which we have no control including, but not limited to large-scale technical malfunctions, including, but not limited to loss of access to the Internet or loss of access to the Federal Reserve System, prolonged outages of phone lines, electricity or similar infrastructure, acts of God, war, riot, civil disobedience or similar events of insurrection, governmental or court orders, regulatory or legislative changes by any local, state or federal governmental agency, strikes, work stoppages, or other similar occurrences or circumstances.
